Hello! Welcome to our new feature, "This Week in USCIS." Every Friday, I’ll compile a digest covering the latest news on H-1B visas and employment-based immigration. I’ll also spotlight a few noteworthy articles or resources that may be of interest to you.

This week, USCIS rolled out a new policy to screen social media for antisemitism, potentially affecting visa applications like H1B, while the April 2025 Visa Bulletin brought mixed news for employment-based immigration. Delays hit EB-5 applicants from China and India, but EB-2 and EB-3 categories saw progress. Other notable updates include the IRS sharing taxpayer data with ICE and USCIS limiting sex recognition to male and female. Here’s what immigrant founders need to know to stay ahead.

2. IRS to Share Taxpayer Data with ICE

The IRS will now share taxpayer details—like addresses and income—with ICE to support deportation efforts. While focused on undocumented immigrants, this could tighten overall immigration enforcement, indirectly impacting H1B holders. Staying compliant and informed is key for founders.

3. April 2025 Visa Bulletin Shows Mixed Results

The April 2025 Visa Bulletin signals setbacks for EB-5 applicants from China and India, with delays stretching over two years. Meanwhile, EB-2 and EB-3 categories edged forward, offering hope for H1B holders awaiting green cards. Check your priority date to plan next steps.

4. USCIS Recognizes Only Two Biological Sexes

As of April 2, 2025, USCIS will only recognize male and female sexes based on birth certificates for all immigration forms, including H1B petitions. This could complicate applications if documents don’t match. Double-check your paperwork to avoid delays.
